The applicant alongwith Shri J. Godinho, learned Advocate for the applicant and the respondent no.1 alongwith Shri V. Amonkar, learned Advocate for the respondent no.1 present in the Court.

Both the parties had talks of settlement and pursuant to which an amount of ₹2,40,000/- (Rupees Two Lakh Forty Thousand only) is agreed to be paid by the applicant to the respondent no.1 as submitted by Shri J. Godinho, learned Advocate on the basis of the instructions. In view thereof, the respondent no.1 shall be held entitled to withdraw an amount of

2 CRIR 39 of 2019 ₹2,40,000/-(Rupees Two Lakh Forty Thousand only) from the amount of ₹2,50,000/- (Rupees Two Lakh Fifty Thousand only) deposited by the applicant partly before this Court and partly before the Additional Sessions Judge, Ponda. It goes without saying that the applicant shall be entitled to the refund of ₹10,000/- (Rupees Ten Thousand only) deposited by him. In view thereof, liberty is granted to the applicant to withdraw the balanced amount as ordered.

Nothing survives in the application which accordingly stands disposed off. Bail Bonds shall stand discharged. The judgments passed by the learned JMFC, Ponda and the Additional Sessions Judge are accordingly quashed and set aside.
