IN THE HIGH COURT OF BOMBAY AT GOA
WRIT PETITION NO.204 OF 2019 ZUARI AGRO CHEMICALS LTD., THR.
ITS AUT. SIGN., SAMRAT SEN., ... PETITIONER
Versus
THE UNION OF INDIA, REP. BY ITS UNDER SECRETARY, MINISTRY OF FINANCE, NEW DELHI AND 2 ORS., ... RESPONDENTS Ms Cijoni Dias, Advocate for the Petitioner.
Ms Asha Desai, Senior Standing Counsel for the Respondents. CORAM:- M. S. SONAK & BHARAT P. DESHPANDE, JJ.
DATED :- 6th September, 2023 P.C.:
Ms Cijoni Dias, learned counsel for the Petitioner based on instructions from the Petitioner seeks leave to withdraw this petition with liberty to file fresh proceedings concerning Respondent No.3's order dated 10.01.2019.
2. Ms Dias points out that initially the Petition was filed to challenge a show cause notice. However, since there was no interim order, Respondent No.3 proceeded to dispose of show cause notice and make an order dated 10.01.2019. Though this petition was amended, it is now realized that fresh proceedings in respect of the order dated 10.01.2019 would be appropriate.

3. Considering the above subsequent developments, leave is granted to withdraw this petition with liberty to file a fresh petition, inter alia to question the order dated 10.01.2019.
4. Accordingly, this petition is disposed of as withdrawn with liberty as prayed for.
5. There shall be no order for costs.
6. The Misc. Civil Applications do not survive the disposal of the writ petition and the same are disposed of accordingly. BHARAT P. DESHPANDE, J.
