The petition is taken up for hearing and is accordingly disposed off.

Learned Advocate for the petitioners submits that on the basis of the findings rendered while deciding the preliminary issue there are clear findings that the Executing Court was not seized with the jurisdiction to deal with the findings in view of the earlier orders of the two Judges dated 1/07/1999 and 17/03/2010 that the Executing Court did not have the jurisdiction. In view thereof, the petition is allowed in terms of prayer clause (a).
