The learned Government Advocate points out that the impugned order is passed under Rule 11 of the Central Civil Services ( Classification, Control & Appeal ) Rules, 1965 and an appeal is provided under Rule 23 thereof. The learned counsel for the Petitioner submitted that the statutory appeal is provided and seeks leave to withdraw the petition to pursue the remedy of appeal.
