1. Respondent Prashuram Raghoba Ghadi present in person.

2. None for the Petitioner, though called thrice. On 24.02.2025, this Court noted that the amount of Rs.3,00,000/- which is directed to be paid as interim compensation by the Magistrate was to be deposited in two installments of Rs.1,50,000/- each, first by 13.11.2024 and the second within four weeks thereof. The Applicant has till date, being granted extension of time under various orders, including order dated 24.02.2025, 24.03.2025 and last order on 09.06.2025, not deposited the balance amount of Rs.1,50,000/-. On 29.04.2025, the Petitioner earlier deposited an amount of Rs.1,50,000/- which as released in 22nd July, 2025

WPCR 39 of 2025 favour of the Respondent no.1 into his bank account, though opposed by the Applicant.

3. On 09.06.2025, the learned Advocate Mr. Vibhav Amonkar for the Petitioner submitted that he had no instructions from the Petitioner and sought to withdraw his appearance after giving notice. On giving notice to the Petitioner Mr. Vibhav Amonkar was discharged from appearing for the Petitioner on 17.06.2025. Even today, when the matter was called out none appeared for the Petitioner.

Considering these facts and the fact that the Petitioner has continuously been in default for depositing the balance amount of Rs.1,50,000/-, the Criminal Writ Petition No.39 of 2025 stands dismissed. The trial Court i.e. the JMFC, Quepem taluka dealing with Criminal Case No.77/OA/NI/2020 shall proceed with the trial and dispose of the same.

5. The interim order dated 12.11.2024 stands vacated. VALMIKI MENEZES, J.
