2. Mr. Dias, the learned Counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to challenge the impugned order in an appeal against the Decree in the suit, if it is adverse to the petitioner.

3. In such circumstances, the petition is dismissed as withdrawn with liberty as prayed. There shall be no order as to costs.

4. It is made clear that this will not entitle the petitioner to seek
