The controversy in this petition concerns the tenure of the Panchayat which ended in June 2022. Therefore, the reliefs in this petition have been rendered infructuous.

Mr. S. Naik, learned counsel for Respondent No.1 relies on Podipireddy Atchuta Desai Vs Chinnam Joga Rao and others 1, in which it is held that when fresh elections have been taken place, the question of validity of dismissal of election petition against the earlier election need not be decided. The Hon'ble Supreme Court held that this would be only an academic issue.
