Heard Mr. Pereira, the learned Senior Counsel for the petitioner and Mr. Pangam, the learned Counsel for the respondent. Perused record.

2. The learned Senior Counsel, on instructions, states that in pursuance of the impugned order, the respondent has already filed an application for amendment of the counter claim being application at exhibit 35 to which the petitioner has filed a reply. He, therefore, submits that the said application may be decided by the Trial Court on its own merits and in accordance with law.

3. In such circumstances, the petition is disposed off with a

WP/409/2019 direction to the Trial Court to dispose off the application at exhibit 35 on its own merits and in accordance with law. The rival contentions of the parties are left open.
