1. Heard learned Counsels for the respective parties.

2. After hearing the matter for sometime, learned Counsel Mr. S. Vales prayed that the Petitioner be allowed to withdraw the petition and to approach the Revisional Court under section 201-B of the Panchayat Raj Act which is an alternate efficacious remedy available for the Petitioner. He further submits that the aspect of limitation be protected as far as filing of revision is concerned.

3. Permission is granted to the Applicant to withdraw this petition 21st December, 2023

WP 920 of 2023 with liberty to approach the Revisional Court.

4. A fresh Revision is filed along with the application for condonation of delay, the Revisional Court shall consider the time consumed by the Petitioner before this Court and decide the application in accordance with law.

5. Mr. Vales submits that the Petitioner undertakes to file the revision on 22nd itself. Accordingly, leave is granted.

6. The petition stands disposed of. It is made clear that all contentions of all parties are kept open.

7. The parties shall act on an authenticated copy of this order.

8. The application for intervention stands disposed of along with the present petition.
