The matter was reserved for judgment. In the meanwhile, the applicants filed an application to produce documents on record under Order 41 Rule 27 of the Civil Procedure Code. The matter was heard in connection with the production of the said documents as well as the relevancy thereof on the disputes raised in the appeal. Both the counsels were permitted to advance their arguments with regard to such documents as well as on the merit or relevancy thereof to decide the questions raised in the appeal. Though it is not disputed that the documents were already on record and marked as exhibits in the proceedings before the learned Trial Judge, the question of filing an application under
MCA/920/2016 Order 41 Rule 27 of the Civil Procedure Code would not arise at all.
2. Be that as it may, both the counsels were permitted to advance further arguments in connection with the said documents and relevancy thereof. Hence, the judgment stands reserved.
