Heard Mr. Preetam Talaulikar, learned Counsel appearing for the petitioner, Mr. Dattaprasad Lawande, learned Advocate General appearing for the respondents No. 1, 5 and 6, Mr. Ryan Menezes, learned Counsel appearing for the respondent No.2 and Mr. P. S. Rao, learned Counsel appearing for the respondent No.4.
2. Pursuant to the orders passed on 14th July, 2017, Mr. Ryan Menezes, learned Counsel appearing for the respondent No.2 has placed on record the Occupancy Certificate granted by the respondent No.4 for the subject construction. Mr. P. Rao, learned Counsel appearing for the respondent No.4 also confirms
WP/1097/2016 that such an Occupancy Certificate has been granted. The Occupancy Certificate is marked "X" for identification.
3. Mr. Talaulikar, learned Counsel appearing for the petitioner states that the petitioner will challenge such occupancy certificate before the Competent Forum.
4. In view of the said Occupancy Certificate, which is marked "X", the legal consequences thereof shall follow, in accordance with law.
5. The petition stands disposed of accordingly. Needless to say that all contentions of the petitioner are left open, in case any such proceedings are initiated by the petitioner, as well as any objections/contentions of the private respondent to that effect, including that of locus standi of the petitioner, are left open.
