1. An application for compounding the offence punishable under Section 138 of the NI Act, of which the applicant was convicted by the JMFC, Vasco in Criminal Case No. 98/NIA/2018/D has been filed by the parties. The application is signed by the parties and their respective Advocates, who have identified the signatures of the parties. The applicant has also deposited with the Goa State Legal Services Authority an amount of Rs.18,000/- towards the penalty in terms of the judgment of Hon'ble Supreme Court in the case of Damodar S. Prabhu v/s. Sayed Babalal H.[2010(5) SC C 663). Considering these facts, compounding application is allowed. The applicant is acquitted of the 7th May, 2025

CRMA 43 of 2025 offence under Section 138 of the NI Act.

2. Since the offence has now been compounded, the Registry is directed to transfer the amount of Rs.1,20,000/- deposited by the Applicant on 26.11.2024 with the Registry directly to the Account of the Respondent No.1, details of which are given below: Name : Fakiresh Dharmanna Lamani Name of the Bank: State Bank of India Branch : Velguem (Goa) Account No. : 41696540426 IFSC : SBIN0003854

3. The transfer has to be carried out within two weeks from today.
