Mr. Pranay Kamat, learned counsel for the Appellant craves leave to delete Respondent No.3. The deletion is allowed subject to the risk and consequences of the Appellant. Necessary amendment to be carried out forthwith.

The learned counsel for the parties hand in the consent terms that are taken on record and marked as 'X' for the purposes of identification. To the consent terms is annexed a report ( Annexure - A ) and the sketch ( Annexure - B). Both these documents shall form a part of the consent terms. Even these documents have been signed by the Appellant and the two Respondents.

The consent terms have been signed by the Appellant and two Respondents. The Advocate for the Appellant and the two Respondents have also signed the consent terms in token of identification of the parties.

The Appellant and the two Respondents are also present in the Court. They state that they have not only signed the consent terms but they have also read and understood the same. They say that they have signed these consent terms after understanding their full scope and import voluntarily and without any pressure from any quarters. 5.
On perusing the consent terms, they appear to be reasonable. 6.
Accordingly, the consent terms are accepted, taken on record and the Second Appeal is disposed of in terms of the consent terms. The impugned decrees to now stand modified in terms of the consent terms. The Second Appeal is disposed of accordingly. There shall be no order for costs.
