Heard Shri C. Padgaonkar, learned Advocate for the petitioners and Shri Rohit Bras De Sa, learned Advocate for the respondent for some time.

On considering the limited issue involved in the petition, i am inclined to quash and set aside the order passed by the learned Trial Judge dated 20/06/2017 and that dated 19/07/2017 with a direction to the learned Trial Judge to permit the petitioners to file the additional written statement on record. Shri Padgaonkar, learned Advocate submits that alongwith his application for enlargement of time he had placed the written statement on record and in view thereof

wp no.1048/2017 the learned Judge to take the same on record. The present petition is allowed with the costs of ₹2,000/- to be deposited in the Goa State Legal Services Authority's account. It has been brought to my notice by Shri Padgaonkar, learned Advocate for the petitioner that initially ad interim was granted subject to the deposit of the costs of ₹10,000/- which shall be refunded to the petitioner.
