Shri Godinho, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application, as the applicant intends to approach the learned Sessions Judge under section 397 of Cr.P.C against the impugned order. The criminal revision application is disposed off as withdrawn, with liberty as prayed for.

2. If the applicant files the criminal revision application within a period of two weeks from today, the learned Sessions Judge shall have due regard to the provisions of sections 5 and 14 of the Limitation Act while entertaining the criminal revision application.
