Mr. J. Godinho, learned Counsel for the petitioner states that the order dated 17/11/2011 is assailed in the present Writ Petition. The said order is passed on an application filed by the defendant vide Exhibit 32 in RCS No.34/2008/F. It is informed by the learned Counsel that the Regular Civil Suit is itself decreed and the First Appeal is also disposed of. It is informed that the Second Appeal No.48/2016 has been instituted in this Court assailing the said judgment passed in the First Appeal and the same is pending for adjudication.

On perusal of the impugned order it can be seen that the application was filed seeking certain directions to be issued to the plaintiff for depositing the set of keys of the locked gate enabling the access of the suit premises which is in possession of the plaintiff. The said application of the defendant came to be rejected. However, since it is informed that the Regular Civil Suit is itself disposed of, the challenge to the said order will not survive. Noting that the Second Appeal instituted is pending in the Court, the present Writ Petition being rendered infructuous is disposed of. SMT. BHARATI H. DANGRE, J.
