Heard Mr. Desai, the learned counsel for the applicant and Mr. Vaz, the learned Special Public Prosecutor for the respondent.

2. The applicant has been sentenced for the offences punishable under section 7 and Section 13(1)(d) r/w 13(2) of the Prevention of Corruption Act. In both the offences the applicant has been sentenced to suffer imprisonment for a period of one year and pay fine of Rs.50,000/- and in default to undergo simple imprisonment for 3 months. The fine is said to be deposited. Indisputably, the applicant was on bail during the course of the trial.

3. Mr. Vaz, the learned Special Public Prosecutor submits that in

CRMA/270/2015 such circumstances appropriate orders may be passed.

4. On hearing the learned counsel for the parties and considering the fact that the applicant was on bail during the trial, the application is allowed. The substantive sentence of imprisonment is hereby suspended on the condition that the applicant furnishes a personal bond in the sum of Rs.10,000/- (Rupees ten thousand only) with one surety in like amount. The applicant shall undertake to remain present during the course of hearing of the appeal. The bail bond to be furnished before the learned Sessions Judge. The application is accordingly disposed of.
