1. This is an application for compounding of offence under Section 138 of the N.I.Act for which the Applicant was convicted by J.M.F.C. Bicholim in Criminal Case No. OA/952/2019/A. The Applicant has deposited an amount of Rs.85,000/- in the Registry of this Court on 07.12.2023, which is the entire compensation amount. In addition, the

Applicant has deposited an amount of Rs.12,750/- with the Goa State Legal Services Authority in compliance of the direction of the Hon'ble Supreme Court in the case of Damodar S. Prabhu v/s. Sayed Babalal H.[2010(5) SC C 663). The applicant has also deposited costs of Rs.10,000/- on 17.03.2025 in the Registry of this Court.

2. The Respondent â€" Mahadev Tukaram Gaonkar is present in the Court and admits that he has signed the compounding application. Considering that the entire compensation amount has been deposited and directions in Damodar S. Prabhu (supra) are complied, the Applicant stands acquitted of the offence under Section 138 of the NI Act.

3. Registry is directed to transfer the amount of Rs.85,000/- along with accrued interest, if any, deposited in this Court on 07.12.2023 directly to the Account of the Respondent-Mahadev Tukaram Gaonkar, details of which are given below:

4. Similarly, the costs of Rs.10,000/- deposited with the Registry on 17.03.2025 shall also be transferred by the Registry of this Court to the

said Respondent - Mahadev Tukaram Gaonkar into the aforementioned account.

5. Registry to comply with these directions within a period of two weeks from today.

6. Revision Application stands disposed of.

7. Pending applications in the Revision Application, if any, also stand disposed of.
