... Applicant
Versus
MRS.MATILDA FERNANDES AND 6 ORS., ... Respondents Shri Vaman Ganesh Kurtikar, Advocate for the applicants. Shri A. Shirodkar, Advocate for the respondent nos.1 to 6. Coram:- NUTAN D. SARDESSAI, J.
Date:- 3rd February, 2017 P.C.
Heard Shri V. Kurtikar, learned Advocate appearing for the applicants and Shri A. Shirodkar, learned Advocate appearing for the respondent nos.1 to 6.
2. There has been a delay of 55 days in filing an appeal on account of the internal communication gap between the Advocate appearing before the MACT and the applicants. Besides, it is borne out from the records that since the MACT had awarded the high compensation, the papers had to be processed at different levels before taking a call whether an appeal has to be filed or not and would occasion the resulting delay of 55 days. These facts asserted on oath have not been seriously controverted by the contesting respondents. i find that
MCA/55/2016 a sufficient cause is made out by the applicants for condoning the delay. In view thereof, the application is allowed and the delay is condoned. Registry to register the appeal.
3. The application stands disposed off accordingly. NUTAN D. SARDESSAI, J.
