During the course of the hearing of the above petition, Mr. G. Naik, the learned Counsel appearing for the respondent no.2 has pointed out that action has already been initiated by the respondent no.2 with regard to the subject structure. The learned Counsel appearing for the respondent no.4 has also pointed out that the Collector is also intending to initiate action with regard to the allegation that no conversion has been obtained of the subject land.

2. In view of the said action being taken by the statutory authority, Mr. D. Shirodkar, the learned Counsel appearing for the petitioners seeks leave to withdraw the above petition.

3. The petition stands accordingly dismissed as withdrawn based on the said statements of the learned Counsel appearing for the respondents. Needless to say all contentions of the parties on merits are left open as we have not examined the correctness or veracity of the rival contentions.
