2. By consent of parties, the petition is disposed off in the following terms:

(i) The impugned order dated 26/9/2017 and the order dated 28/9/2017 are hereby set aside.

(ii) The respondent no.1 would file appropriate application for attachment, before the Executing Court within two weeks from today. On such application being filed, the petitioner shall be entitled to file a reply within one week thereafter. The Executing

WP/1062/2017 Court shall decide the application for attachment afresh in accordance with law, after hearing the parties. (iii) The Executing Court shall decide the application as expeditiously as possible and in any event within twelve weeks from today.

(iv) In the meantime, the bank shall continue to retain the amount (which is already withheld) for a period of twelve weeks from today. This will be subject to the orders as may be passed by the Executing Court.

(v) The petition is disposed off in the aforesaid terms with no order as to costs.
