Heard Mr T. Sequeira, learned counsel for the Applicant. 2.

Mr Sequeira points out that in a connected matter i.e. Misc. Civil Application No.1055 of 2019 in Stamp Number Main No.65 of 2018 (F), this Court made the following order on 10.11.2022. "1. Heard Mr.

T. Sequeira for the applicants.

2. Considering the reasons set out in the civil application and the affidavit filed by the Advocate, the delay is condoned. Further, based on the same reasons, 14th July 2023

16-MCA 1058-19.DOC the Registrar's order dated 05.10.2018 is set aside and the Second Appeal is restored to the file.

3. The aforesaid order is made based on the statement of Mr. T. Sequeira that the appellant or his Counsel without giving any excuse whatsoever will clear the office objections or take steps within one week from today without seeking any extension of time. If no steps are taken within one week, then, the matter to stand dismissed for non-prosecution without further reference to this Court.

4. Misc. Civil Application No.1055 of 2019 is disposed of.

Accordingly, by following the same course of action, this application is allowed. The delay is condoned. The Registrar's order dated 20.07.2018 dismissing the Second Appeal for non-prosecution is set aside and the Second Appeal is restored to the file. 4.

The aforesaid order is made based on the statement of Mr T. Sequeira that the Appellant or his counsel without giving any excuse will clear the office objections and will take steps within two weeks from today without seeking any extension of time. If no steps are taken within two weeks, the matter to stand dismissed for nonprosecution without further reference to this Court. 5.

The Misc. Civil Application No.1058 of 2019 is disposed of. M. S. SONAK, J.
