Heard. Mr. Lotlikar, the learned Senior Counsel for the applicant and Mr. Bhobe, the learned counsel for the respondent.

2. Admittedly, the respondent was under an obligation to pay the compensation at the rate of Rs.50,000/- (Rupees Fifty thousand only) per month to the applicant. This Court by a judgment and order dated 5/7/2018 in W.P. No.434/2018 had directed the respondent to deposit Rs.75,000/- (Rupees Seventy five thousand only) per month before the learned trial court. Considering this, the application is allowed. The amount deposited before the trial court by the respondent along with interest, if any, shall be paid

MCA/1019/2018 to the applicant.

3. Any further amount paid by the respondent every month shall also be allowed to be withdrawn by the applicant.

4. This shall however, be subject to the rival contentions of the parties and subject to the outcome in the suit. C. V. BHADANG, J.
