IN THE HIGH COURT OF BOMBAY AT GOA

CIVIL APPLICATION (REVIEW) NO. 34 OF 2018 IN WRIT PETITION NO. 367 OF 2018 CHOWGULE INDUSTRIES PVT. LTD., THR. AUT. PERSON, SUJAY RAO., ... Applicant

Versus

THE COMMISSIONER LABOUR AND EMPLOYMENT, PANAJI AND 51 ORS., ... Respondents Shri P. Talaulikar, Advocate for the Applicant. Shri V. Sardessai, Addl. Government Advocate for the Respondent No.1.

Shri S. Gaonkar, Advocate for the Respondent No.2. Coram:- NUTAN D. SARDESSAI, J.

Date:- 5th December, 2019 P.C.:

Shri P.Talaulikar, learned Advocate prays for a status quo for a period of six weeks in order to avail the remedy of an appeal before the Hon'ble Apex Court.

2. Shri S. Gaonkar, learned Advocate opposes the same on the premise that such a prayer was made and time was granted to the applicant herein to pursue the remedy of appeal. He had however not pursued such a remedy but had instead preferred a review application which has come to be dismissed today. In view

CAREV/34/2018 thereof, he submits that no stay be granted in favour of the applicant.

3. It is a matter of record that the applicant was secured with an order of stay of six weeks pursuant to the order dated 29.10.2018. The review application has been dismissed seeking a review of the judgment dated 29.10.2018. The applicants do have a statutory remedy of appeal before the Hon'ble Apex Court which cannot be denied to them.

4. In the circumstances therefore, and in the interest of justice operation of the order is stayed for a period of six weeks. NUTAN D. SARDESSAI, J.
