1. Heard Mr. P. Lotlikar, learned Counsel for the Applicant and Mr. P. Kakodkar, learned Counsel for the Respondents.

2. An application filed along with the authority letter of the Applicant praying for withdrawal of CRA No.39/2018 unconditionally.

3. Mr. Kakodkar submits that the Applicant who is the Defendant is filing multiple applications under Order 7 Rule 11 of CPC and CRA No.3/2024 is filed by the Applicant against the rejection of his second application. He submits that the issue with regard to multiple applications could be kept open even if the present revision is allowed 13th June, 2024

CRA 39 of 2018 to be withdrawn.

4. The contention of Mr. Kakodkar could be accepted by keeping open the issue with regard to the filing of multiple applications under Order 7 Rule 11 by the same party.

5. Accordingly CRA 39/2018 is permitted to be withdrawn unconditionally.
