The learned counsel for the respondent no.2 states that the proceedings have been disposed off on 23/2/2017. He submits that the respondent no.2 was not holding the charge of the Chief Officer at the time when the order was passed on 15/7/2016 of which contempt is alleged. It is submitted that the respondent no.2 is posted as Deputy Collector and SDO Quepem and is holding additional charge of the Chief Officer of Cuncolim Municipal Council and in the recent past was also entrusted with election duty. It is submitted that in these circumstances, the respondent no.2 could not comply with the order within the time as specified. It is, however, submitted that the same is unintentional. The respondent no.2 has tendered unconditional

CP/2/2017 apology.

2. Having heard the learned counsel for the petitioner and the respondents and having regard to the fact that the respondent no.2 has now passed the order on 23/2/2017 and for the reasons stated above, the apology tendered is accepted and the contempt petition is disposed of.
