(i) The petition is partly allowed. The impugned order is hereby set aside.

(ii) The application filed by the respondent no.3 for grant of pardon is restored back to the file of the learned Sessions Judge

CRIR/6/2019 for disposal according to the law.

(iii) It will be open for the learned Sessions Judge to consider the said application on its own merits after framing of the charge. (iv) Rival contentions of the parties are left open. (v) Needless to mention that the ad interim relief stands vacated. C. V. BHADANG, J.
