The above appeal challenges the judgment and decree dated 31.12.2010 passed by the learned Trial Judge whereby the suit filed by the respondent was decreed and the appellant was directed inter alia to pay to the respondent a sum of Rs.5,00,000/- along with interest accrued thereon at the rate of 12% per annum from 01.04.1998 up to the actual payment which came to be confirmed by the learned Appellate Court by judgment dated 07.11.2015.

2. After hearing the matter for some time, both the learned counsel sought time to amicably settle the matter and the matter was taken up today. Both the learned counsel submitted upon

SA/39/2016 instructions that the matter has been amicably settled and the appeal be disposed of in terms of the minutes of the order which are duly signed by the appellant and his Advocate and the learned Advocate for the respondent upon instructions. The minutes of the order are taken on record and marked 'X' for identification.

3. In view of the above, I pass the following : O R D E R (i) The appeal is partly allowed.

(ii) The judgments passed by the learned Trial Court dated 31.12.2010 and the learned Appellate Court dated 07.11.2015 stand modified and the suit filed by the respondent stands decreed in terms of the minutes of the order marked 'X' for identification.

(iii) The appeal stands disposed of accordingly with no order as to costs.

(iv) Decree to be drawn accordingly.
