2. After this matter was argued for some time, the learned Counsel for the parties state that this Petition can be disposed of with the following agreed order :
(a) The Petitioner will pay to the Respondent-Bank, within a period of three weeks from today, an amount of ₹ 12,00,500/- in full and final settlement on account of loan account No.00055710000043.
(b) Upon receipt of the aforesaid amount, the RespondentBank will issue necessary certificate closing this particular
2 Wp428-19.dt.16-7-19 loan account and further release/redeem the mortgaged property i.e. residential flat No.F-2, Bhanudeep Nest, Joefil Nagar, Ponda, Goa and shall also return the necessary title documents within three weeks. All this exercise will be completed by the Respondent-Bank within three weeks from the date of receipt of the amount as aforesaid. (c) If, for any reason, the Petitioner fails to pay the aforesaid amount within three weeks from today, then, this Petition shall be deemed to have been dismissed, without further reference to this Court.
(d) The Respondent-Bank is free to take such other proceedings as may be permissible under law in respect of the recoveries against other loan accounts of the Petitioner or concerns in which the Petitioner has interest 3.
The Petition is disposed of in the aforesaid terms. 4.
All concerned to act on the basis of an authenticated copy of this order.
