During the course of argument at bar, it transpired that the respondent has paid an amount of Rs.22,000/- for the month of November, 2018 and an amount of Rs.5,000/- towards the maintenance for the month of December, 2018. Thus, the deficit for both these months together is Rs.73,000/-. In addition, an amount of Rs.50,000/- representing the maintenance for the month of January, 2019 can also be allowed to be withdrawn as by consent of parties, the main petition is being fixed for final disposal in the month of January, 2019. In such circumstances, the application is partly allowed.

2. The applicant is permitted to withdraw an amount of Rs.1,23,000/- from the amount deposited before this Court.

MCA/997/2018 Remaining amount along with interest, if any, shall continue to be invested in a Nationalised Bank.

3. By consent of parties, W.P.No.464/2017 along with connected petition is fixed for final disposal on 21/01/2019. C. V. BHADANG, J.
