Mr. Fernandes, learned Counsel for the petitioner on the basis of instructions from the petitioner, seeks leave to withdraw the Writ Petition with liberty to pursue the application made under Section 127(1) of Cr.P.C. before the learned Magistrate.

2. Leave is granted and this petition is disposed off as withdrawn with liberty as prayed for.

3. The respondents shall be at liberty to withdraw the amount of Rs.5 Lakhs deposited by the petitioner in this Court. Such withdrawal shall ultimately be subject to the orders that shall be made by the learned Magistrate in the application under Section 127(1) of Cr.P.C.
