Shri J. Ramaiya, learned Advocate for the applicant prays for the suspension of the sentence on the premise that the parties have entered into a Memorandum of Understanding dated 27/11/2019 pursuant to which an amount of ₹25,000/- has also been paid to the respondent/complainant and besides an amount of ₹37,500/- has been deposited before the Sessions Court. Besides, there is an understanding that an amount of ₹55,000/- would be paid to the respondent in February,2020 and the balance amount of ₹55,000/- would be paid in April,2020. In view thereof, he prays for the suspension of the sentence of the judgment dated 10/11/2017.

In view of the Memorandum of Understanding arrived between the parties pursuant to which the interest of the respondent has been duly secured by part payment and assured with the balance amount by April,2020, the judgment and sentence is stayed. The applicant is ordered to be enlarged on bail upon execution of a personal bond in the amount of ₹10,000/- (Rupees Ten Thousand only) and one local surety in coextensive amount to the satisfaction of the learned JMFC, Quepem.
