Mr. H.D. Naik, the learned Counsel for the Applicant states that the Applicant will be satisfied if the contention raised by the Applicant regarding non-service of notice as per Section 52-A of the Goa Industrial Development Corporation Act, 1965 is kept open to be agitated in an Appeal if such an eventuality arises.

In view of this statement it is not necessary to examine the correctness of the impugned order. The contentions

Santosh 2 cra13-17dt.16-11-17 of the parties with regard to service of a statutory notice are kept open, to be considered in an appeal, if situation so warrants. 3.

If an application is made by the Applicant for extension of time to file Written Statement, the learned Trial Judge will consider the same favourably, in view of the fact that the Applicant was prosecuting the Application under Order 7, Rule 11 C.P.C.
