Accordingly, in view of the settlement arrived at between the parties, the offence is compounded. The judgment and order dated 26.04.217 passed by the learned JMFC in Criminal Case No.552/OA/NIA/2014/A as well as the judgment and order dated 28.11.2018 passed by the Appellate Court in Criminal Appeal No. 73/2017, are hereby quashed and set aside and the accused is acquitted from the charge of having committed offence punishable under Section 138 of the Negotiable Instruments Act. 2.
