This petition is filed under Section 482 of the Criminal Procedure Code for quashing of FIR No.121/2016 registered with Panaji Police Station on 2nd December, 2016, at the instance of respondent no.2, the wife, for the offence punishable under Section 498-A of the Indian Penal Code.
2. Both the parties i.e. the petitioner, husband and respondent no.2, wife today file joint application for quashing of the FIR. It is stated in the joint application that the complaint by the wife was an outcome of frustration and misunderstanding between the two. The application also states that both the sides have amicably resolved the matrimonial dispute and have filed
WPCR/158/2016 proceedings for mutual divorce wherein the issues of custody of the minor son and the maintenance to respondent no.2 and the minor son are taken care of. Copies of those proceedings are annexed to the joint application.
3. Perused the application. Heard Counsel for both sides. The parties are also present in the Court. In the circumstances of the case the petition is allowed in terms of prayer (a). C. V. BHADANG, J.
