1. This is an Application for Compounding of the offence in which the applicant has been convicted under Section 138 of NI Act.

2. By an order dated 17.02.2021, this Court had directed that the entire compensation deposited in this Court to be paid to the Account of the Respondent /Complainant. The same has been complied with, and the Respondent No.1 has received the entire compensation amount, and 15% of the compensation is deposited with the Goa State 24th June, 2025

CRMA 298 of 2019 Legal Services Authority as a penalty in compliance with the judgment of Hon'ble Supreme Court in the case of Damodar S. Prabhu v/s. Sayed Babalal H.[2010(5) SC C 663).

3. The Respondent appeared through Advocate Mr. Tanmai Gauns, but past several hearings he has not put in appearance, perhaps because he had received the entire compensation amount. Considering these facts, the application for compounding is allowed. The applicant is acquitted of the offence under Section 138 of the NI Act.

4. CRMA No.298 of 2019 stands disposed of accordingly.

5. In view of the above, CRIR No. 46 of 2019 also stands disposed of. Rule stands discharged.
