On hearing the learned Counsel for the petitioner, I do not find that any case for interference is made out. The petitioner is yet to open his evidence and it would be open to the petitioner to lead his own evidence and to produce the documents, as he may decide in support of his defence. The learned Tribunal, in my considered view, is right in holding that if at all, according to the petitioner the statement of DW-1 in his cross examination is incorrect, it is for the petitioner to satisfy the Tribunal.
