Mr. Panandiker, learned counsel appearing for the Petitioner on the basis of the instructions from the Petitioner fairly states that the relief in this petition has now rendered infructuous as the subsequent developments have overtaken the issue raised in this petition. He points out that the assessment order is made out on 29th December, 2018 and as against the same, the Petitioner has also instituted an appeal. Accordingly, he seeks leave to withdraw the petition with liberty to pursue the appeal. Leave is granted with liberty as prayed for.
