After arguing the matter for sometime, the learned Counsel appearing for the petitioner upon instructions seeks leave to withdraw this petition with liberty to agitate the issue raised in this petition by filing appropriate proceedings and more particularly Civil Suit.

2. Writ Petition is dismissed as withdrawn with liberty as prayed for. It is made clear that this Court has not expressed any view on merits of the matter. If any Civil Suit is filed by the petitioner, the same would be considered on its own merits. PRITHVIRAJ K. CHAVAN, J.
