ORDER

Heard Shri S. Shet, learned Advocate appearing for the Applicant and perused the Judgment.

The Applicant seeks the suspension of the impugned Judgment pursuant to which his Appeal has been rejected for default and directions issued to the Trial Court for issuing of warrant of arrest. The Applicant had carved a case that he has been suffering from malignancy and that on account of the said condition and chemotherapy treatment taken by him, he was unable to appear before the learned Sessions Judge which passed the impugned Judgment.

In the circumstances therefore and as the Applicant has CRMA 333-17

-2otherwise shown his willingness to make the deposit of the balance amount of the cheque within time and by considering also the fact that the matter has to be heard on merits, the impugned Judgment is suspended. The Applicant shall however deposit the balance amount of the cheque i.e. ₹1,12,677/- within two weeks from today considering his medical condition.
