1. Mr. S.D. Padiyar, learned counsel appearing for the Sankhali Municipal Council, makes a statement that the Municipal Council has no intention of undertaking any further development in the suit plot, unless they take resort to the provisions of Section 85 of the Goa Municipalities Act, 1968. This statement is accepted.

2. Mr. Vivek Angelo Rodrigues, learned counsel for the petitioners states that on the basis of the aforesaid statement, he does not wish to press this petition any further. However, he adds

WP/119/2019 that all contentions, including the contentions as regards the applicability of Section 85 of the Goa Municipalities Act, 1968, may be kept open.

3. Accordingly, this petition is disposed of on the aforesaid basis, by leaving open all the contentions of all the parties. PRITHVIRAJ K. CHAVAN, J.
