CORAM:
SANDEEP K. SHINDE, J DATED:
th June 2022 _______________________ P.C.
1.
The Petitioners herein had challenged the elections of the Village Panchayat of Calangute before the Administrative Tribunal relating to period 2017-2022. Pending challenge, an application was moved by the Respondents under Order 7 Rule 11 seeking rejection of Petition on preliminary objection. The objection was upheld and Petitions were dismissed vide Order dated 18.12.2018. These Petitions challenge that order.
2.
Pending Petition, the Government of Goa, Department of Panchayat Raj and Community Development, issued a Notification in June 2022 for holding the Panchayat elections for the period 20222027. 3.
In the case of Podipireddy Atchuta Desai vs. Chinnam Joga Rao & Ors.
1, the Apex Court has held that having regard to the fact that the fresh elections have already taken place, appeal has become redundant and it would be futile exercise if the validity of the elections are examined.
4.
Under these circumstances, this Court is of the view that the Petitions call for no consideration and without expressing any view on validity of the impugned order, Petitions are disposed of. SANDEEP K. SHINDE, J PEREIRA Date: 2022.06.21 19:20:22 +05'30'
