1. After hearing this matter for some time, the learned Advocate for the Petitioner sought leave to withdraw this petition, based upon instructions from the Petitioner who is present in Court. Learned Advocate for the Petitioner sought a period of three months within which he states that the Petitioner would demolish the concerned structure which is described in para 3 of an undertaking of today's date which he was directed to place on record before this Court. The concerned structure which admeasures 7.50 metres x 3.50 metres is situated at Chalta Nos.144 and 145 of P.T. Sheet No.237 of City Survey Margao, near Texeira Building, Pedda in Margao city. 18th January, 2024

2. The undertaking of the Petitioner is accepted by this Court and shall be filed in the Registry within the course of the day. In terms of the undertaking, the Petitioner shall demolish the structure described above within a period of three months from today.

3. The petition shall stand dismissed as withdrawn with the undertaking as referred herein. Needless to state that the Margao Municipal Council who represents before me today shall ensure compliance of the undertaking of the Petitioner within the timeline set down therein.
