This is an application for bail.
2. The applicant was arrested in connection with the investigation of Crime no.271/2018 of P.S. Panaji for the offence punishable under section 370 of I.P.C, r/w sections 4 and 5 of the Immoral Trafficking (Prevention) Act, 1956. The applicant was arrested on 9/11/2018 and is presently in judicial custody. Indisputably the investigation of the offence is complete and the charge sheet is already filed. With the assistance of the learned counsel for the parties, I have gone through the charge sheet and the statement of the victim, who is stated to be 30 years of age and is hailing from Andhra Pradesh. Prima facie at this
CRMAB/380/2018 stage on the basis of the statement of the victim it cannot be inferred that there was any element of coercion or the victim was forced into the prostitution.
3. Considering the overall circumstances and having regard to the fact that the investigation is complete, I find that the applicant can be enlarged on bail subject to conditions. Hence the following order is passed:
ORDER:
(i) The applicant shall be released on bail on furnishing of P. R. Bond in the sum of Rs.50,000/- (Rupees Fifty thousand only), with two solvent sureties of Rs.25,000/- each, out of which atleast one surety shall be a local surety.
(ii) The applicant shall undertake to remain present before the learned Sessions Judge during the course of the trial. (iii) The applicant shall not influence and/or tamper with the prosecution evidence or witnesses.
(iv) The applicant shall furnish her local as well as native address along with proof before the learned Sessions Judge. (v) The bail bonds to be furnished before the learned Sessions

(vi) In the event of breach of any of the conditions, liberty to the prosecution to apply for cancellation.
