It is the case of the petitioner that though the petitioner was appointed in the year 2009 and the proposal of the petitioner was sent to the Education Officer from time to time for grant of approval, the Education Officer has not taken any decision on the proposal of the petitioner till date. It is stated that without deciding the proposal of the petitioner, by an order dated 6th January, 2015, the Education Officer has directed the respondent-management to absorb a surplus teacher though there is no vacancy of a teacher for English subject. The learned counsel for the petitioner seeks a direction to the Education Officer to decide the proposal of the petitioner within a time frame.

914.WP1246_2015.doc Since the prayer made by the petitioner is innocuous, we dispose of this Petition with a direction to the Education Officer to decide the proposal of the petitioner, if not decided earlier, as early as possible and positively within a period of four weeks. The order of the Education Officer directing the Management to absorb the other teacher is stayed till the proposal of the petitioner is decided.

Order accordingly. No costs.
