Learned counsel for the petitioners points out that Writ Petition No.1245/2000 and Writ Petition No.1569/2000 were initially directed to be tagged along with present petition. Writ Petition No.1245/2000 pertains to a different educational institution. In any case, he further submits, Writ Petition No.1245/2000 and Writ Petition No.1569/2000 as per the office note appearing in the cause list, have been disposed of on 6.2.2009 and 10.1.2001 respectively. He further submits that the complainant Dr. Zaverchand Ranmal Haria has filed an affidavit in December 2002 stating that in view of the facts discovered by him subsequent to filing of F.I.R., he is convinced that he does not wish to proceed against the petitioner in the present case and, therefore, this Court may pass an appropriate

Learned A.P.P. to seek instructions in the matter and place before the Court facts relating to the present stage of the investigation.
Registry is directed to make available copies of the affidavit filed by the complainant in December 2002 to learned A.P.P. as well as learned counsel for the petitioners at their cost.
