1] On 14.7.2021, we passed the following order:

"1.

Learned counsel, on instructions, submits that the sole appellant-Sanjay Laxman Adhav expired during the pendency of appeal. Learned counsel submits that though the hard copy of death certifcate was not made available to her, the death certifcate has been forwarded to her on whatsapp yesterday only and she would place on record hard copy of death certifcate within one week from today. The statement made by the learned counsel is accepted as an undertaking to this Court. In view of the submission of learned counsel, subject to placing on record by her the hard copy of death certifcate, the appeal is disposed of as abated."

2] The matter was thereafter listed before this court as photocopy of death certifcate was fled. We, therefore, instructed to learned APP to take instructions from the concerned police station.

4-apea-168-2000.doc 3] Today, the learned APP has tendered a photocopy of death certifcate received from concerned police station, issued by the Municipal Council, Phaltan, stating therein that Shri Sanjay Laxman Adhav expired on 11.5.2021 at Sidhnath Hospital Phaltan. A photocopy of the death certifcate is taken on record and marked as "X" for identifcation. 4] As appeal is already disposed of, no further order is required to be passed.
