The grievance of the prisoner is because of administrative delays he could not avail the furlough leave of 28 days in 2018 and its part was availed in the beginning of the year 2019. Because of this, he could not get furlough leave in 2019. Learned APP submits that the prisoner was transferred to open prison. Hence, fresh orders on his furlough leave were required to be passed. As such he enjoyed furlough leave partially in 2018 from 24/12/2018 to 31/12/2018 and the balance period upto 22/1/2019 in the year 2019.

Now yaer 2019 is already over. We therefore, find that the petition has become infructuous. However, we direct the nilegaonkar 1/2

Petition is disposed of. Copy of this order be served upon the prisoner in jail.
