By this Civil Application, Application is seeking condonation of delay in filing Civil Application for bringing legal heirs on record of deceased Applicant no.1, Uttareshwar Mahadeo Gurav, who died on 28.08.2016.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Mohite 1/2
9 cao622-18.doc Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:
a) Delay in filing the Civil Application is condoned. b) Applicant is permitted to bring legal heirs on record of deceased Applicant no.1 in pending proceeding. c) Amendment be carried out on or before 15.03.2019, failing which the Civil Application shall stand dismissed without further reference to the court.
d) If amendment is carried out within stipulated time as stated hereinabove, Applicant to serve amended copy of proceeding on other side immediately thereafter. e) Civil Application stands disposed of accordingly. (K.K. TATED, J.) Mohite 2/2
