Heard Mr. Sonawane, learned Counsel appearing for the Applicant and Ms. Shinde, learned APP for the Respondent-State. 2.

This is an Application fled under Section 439 of the Code of Criminal Procedure, 1973, for regular bail. The relevant details are as follows:- Sr. No. Description Details C. R. The Applicant is a transgender and the allegation against the Applicant is that the Applicant has harassed one devotee in the Shri. Vitthal-Rukmini Mandir, Pandharpur. The allegation against the Applicant is that the Applicant has abused the devotee.

Although the Charge-sheet is not fled, in the Application seeking remand itself it is stated that the investigation is complete.

Accordingly, the Applicant can be enlarged on bail by imposing conditions. Hence, the following Order:

O R D E R

(a) The Applicant Pankaj Bharat Chavhan in connection with C.R. No.738 of 2023 registered with the Pandharpur City Police Station, Pandharpur shall be released on bail on furnishing P.R. Bond in the sum of Rs.5,000/- with one or two sureties in the like amount.

(b) On being released on bail, the Applicant shall furnish his contact number and residential address to the Investigating Offcer and shall keep him updated, in case there is any change.

(c) The Applicant shall report to the Pandharpur City Police Station, Pandharpur once every week i.e, on every Sunday between 11.00 a.m. and 1.00 p.m. till the fling of the Chargesheet.

(d) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing the facts to Court or any Police Offcer. The Applicant shall not tamper with evidence.

(e) The Applicant shall attend the trial regularly. The Applicant shall co-operate with the trial Court and shall not seek unnecessary adjournments.

The Bail Application is disposed of.
